This Privacy Policy (this "Policy") has been created by GALVAGNIZED LLC (the "Company") in order to advise you regarding the type of information the Company may collect about you when you use its website located at WWW.SURYASUCCESS.COM and all associated domains (the "Site"), and the manner in which the Company may use that information.  Please note that the Company reserves the right to modify this Policy at any time.  If this Policy is modified, the Company will post the new Policy here and it will become effective immediately upon such posting.  You should return to this Policy often to see if it has changed.  By accessing or using the Site, any of the content, information or other materials appearing on the Site (collectively, the "Content") or any of the services provided in connection with the Site (collectively, the "Services"), you acknowledge that you have read and do fully understand this Policy and agree to be bound by it terms (as may be modified from time-to-time).  
 
The Company collects personal information that you may provide to it, such as your e-mail address, name, phone number, address, and credit card information. The Company generally collects this personal information on its registration and order forms when you sign up to use the Site, the Content or the Services. The Company may request information about your interests and activities, progress and statistics, your gender and age, income level and other demographic information as well as public information such as user ratings and reviews and other information you view on the Site. You may choose not to provide the Company with certain information, but that may result in your inability to use certain features on the Site because such information may be required in order for the Company to present personalized recommendations to you, register as a member or user, purchase products or services, participate in a contest, promotion or survey, ask a question or initiate other transactions on the Site. The Company may also collect personal information from online surveys, evaluations, and questionnaires, where you may be asked to provide information regarding how stress has been impacting your life, how you feel before and after the exercises, your daily and weekly progress throughout the program, and improvements you are experiencing as a result of the exercises.
 
The Company may collect IP addresses (the number assigned to computers on the Internet) and anonymous demographic information.  The Company' s servers automatically recognize visitors' domain names and IP addresses.  No personal information about you is revealed in this process. The Site may also gather anonymous "traffic data" that does not personally identify you, but that may be helpful for marketing purposes or for improving the Site, the Content or the Services.

From time to time, the Company may use the standard "cookies" feature of major browser applications that allows it to store a small piece of data on your computer about your visit to the Site.  The Company does not set any personally identifiable information in cookies, nor does it employ any data capture mechanisms on the Site other than cookies.  Cookies help the Company learn which areas of the Site are useful and which areas need improvement.  You can choose whether to accept cookies by changing the settings on your browser.  However, if you choose to disable this function, your experience at the Site may be diminished and some features may not work as they were intended.

Under some circumstances the Company may require certain additional information, including but not limited to your credit card billing information. By making a purchase, or engaging in any other activity that requires financial information on the Site, you agree that the Company may provide your financial information to the Company's service providers and to such persons we determine necessary to support and process your activities and transactions, as well as to your credit card issuer. By purchasing or registering for services of other persons offered on the Site, you consent to our providing your financial information to those persons. The Company is not responsible for the acts or omissions of such third party payment processor or the security of your personal information collected and stored by such processor. The Company makes no representations or warranties of any kind as to the measures, if any, which such processor may have in place to protect against the loss, misuse or alteration of your personal information. You should make sure you read and understand the policies and procedures of such processor and direct any concerns you may have to such processor.

The Company may use your personal information and any other information that it may collect for a variety of purposes, including, without limitation, fulfilling your orders or requests, providing you with information about the Company and the Company's approved-partners, contacting you when necessary, tailoring your experiences at the Site by showing content in which the Company thinks you will be interested and displaying content according to your preferences, evaluating and improving its services and developing and featuring consumer research.  

The Company may share the anonymous demographic information it collects with advertisers and market researchers on an aggregate basis.

The Company may also share the information it collects with third party companies who may offer products or services in which Company believes you may be interested. Company also shares this information with third parties with whom Company partners. You may elect not to receive promotional e-mails from Company or such third parties by following the "opt out" provisions set forth in the emails you receive.
 
The Company may also share the information it collects with third party service providers to manage certain aspects of the services which the Company provides, such as maintaining its servers and processing or fulfilling orders for products and services you purchase through the Site. The Company may also collect and store personal information about other people that you provide. If you use the Site to sign up other persons or send information of interest them, the Company may store your personal information and the personal information of each such recipient.
 
The Company may use cookies to deliver content specific to your interests, to save your password so you do not have to re-enter it each time you visit the Site, or for other purposes. Promotions or advertisements displayed on the Site may contain cookies. The Company does not have access to or control over information collected by outside advertisers on the Site. The Company may provide areas on the Site where you can post information or upload content (e.g., pictures). Such postings are governed by the Terms and Conditions of Use. Such postings may appear on other websites or when searches are executed on the subject of your posting. Also, whenever you voluntarily disclose personal information, on publicly viewable web pages, that information will be publicly available and can be collected and used by others. The Company cannot control who reads your posting or what other users may do with the information you voluntarily post.
 
The Company may also disclose your personal information in special cases if it is required to do so by law, court order or other governmental authority or when the Company believes in good faith that the disclosing of your personal information is otherwise necessary or advisable to conform to the edicts of any law, court order or other governmental authority, to protect and defend the rights or property of the Company or the users of the Site, or to act under exigent circumstances to protect the safety of the public or users of the Site, including, without limitation, to identify, contact or bring legal action against someone who may be causing injury to or interfering with the rights or property of the Company, another user or anyone else that could be harmed by such activities.  For example, this means that if the Company conducts a fraud investigation and conclude that someone has engaged in deceptive practices, the Company can give that individual's or entity's contact information to victim(s) who request it.

In order to accommodate changes in the Company's business, the Company may sell or buy portions of the Company or other companies or assets, including the information collected through the Site.  If the Company or substantially all of its assets are acquired, customer information will be one of the assets transferred to the acquirer.

The Company is committed to maintaining the security of your personal information and has measures in place to protect against the loss, misuse and alteration of the information under its control.  However, please note that your personal information will be stored and processed on the Company's computers in the United States.  The laws on holding personal data in the United States may be less stringent than the laws of your country.  The Company follows generally accepted industry standards to protect the personal information submitted to the Company, both during transmission and once the Company receives it (including physical, electronic and procedural measures) to help safeguard your personal information from unauthorized access and disclosure. However, no system can be completely secure. Therefore, although the Company takes steps to secure your information, the Company does not promise, and you should not expect, that your personal information, searches, or other communications will always remain secure.  Users should also take care with how they handle and disclose their personal information and should avoid sending personal information through insecure email.

The Site may contain links to other websites.  By clicking on banner advertisements or other links, you will be redirected off the Site to third party websites. This Policy does not apply to such websites.  The Company is not responsible for the terms of use of such websites, the privacy policies of such websites, the content on such websites or the transactions processed on or through such websites.  You should make sure you read and understand the terms of use and the privacy policies of these websites and direct any concerns you may have to the website administrators or webmasters of these third party websites.
 
All newsletter emails you receive from the Company will include specific instructions on how to opt out of receiving future emails, which you may do at any time.  Please note, however, you cannot opt out of receiving emails from the Company regarding your account or the status of an order.

If you are a resident of California, in addition to the rights set forth above, you have the right to request from the Company information regarding the manner in which it shares certain categories of personal information with third parties for their direct marketing purposes.  To make such a request, please write to the Company at win@suryasuccess.com.

Unfortunately, the Company does not maintain any procedures for you to review or request changes to the information that it collects about you.  If you object to your personal information being transferred or used as described in this Policy, please do not subscribe, join or seek membership to the Site or otherwise access or use the Site, the Content or the Services.

The Company may retain copies of any and all correspondence that may occur between you and the Company in its records.  The Company may retain these records in order to measure and improve its customer service and to investigate potential fraud and violations of its Terms and Conditions of Use.  The Company may, over time, delete these records if permitted by law.

This Policy shall be construed in accordance with and governed by the laws of the United States and the State of California, without reference to their rules regarding conflicts of law.  You hereby irrevocably consent to the exclusive jurisdiction of the state or federal courts in Los Angeles County, California, USA in all disputes arising out of or related to the use of this Policy.

The Company may, in its sole discretion and without prior notice, revise this Policy.  The Company shall post any revision to this Policy on the Site, and the revision shall be effective immediately on such posting.  You should review this Policy periodically to be aware of any revisions.  By continuing to use or access the Site, the Content or the Services following notice of any revision, you must abide by any such revision.

For purposes of this Policy, (a) the singular number shall be interpreted as the plural number and the gender shall be interpreted as masculine, feminine or neuter, each as the context dictates, (b) the words "including," "include," or "includes" or words of similar import shall not, unless otherwise provided, be construed as words of limitation, (c) the word "or" shall be deemed to include the word "and/or", and (d) the word "person" shall mean any individual or entity.

This Policy contains the entire understanding between you and the Company concerning the subject matter hereof and supersedes and replaces all prior understandings and agreements, whether oral or written, express or implied, between you and the Company respecting the subject matter hereof.

In the event that any provision of this Policy should ever be adjudicated by a court of competent jurisdiction to be illegal, invalid or unenforceable in any respect, as determined by such court in such action, then such provision will be deemed reformed to the maximum extent permitted by applicable law.  In addition to the above, the provisions of these Terms and Conditions of Use are severable, and the illegality, invalidity or unenforceability of any provision hereof will not affect the validity or enforceability of any other provision hereof, which will remain in full force and effect as if executed with the illegal, invalid or unenforceable provision eliminated.
